Although popular in the international construction industry, the “FIDIC Conditions of Contract for Construction for Building and Engineering Works Designed by the Employer 1999” is highly complex and fraught with difficulties when used. It contains numerous deadlines for action, a myriad of options when things go wrong and has strict procedures which, if incorrectly applied, may result in huge financial penalties.
The ARCUS Guide to FIDIC APP simplifies the use of the FIDIC RED Book 1999 by providing practical advice and suggestions for the three main players (i.e. the Employer, the Contractor and the Engineer). In addition, it stores relevant project information, provides timely reminders of key events and deadlines and allows the recording of critical events as they occur.
The overall objective of the system is to enable practitioners to easily follow correct procedures, be assured that all contractual requirements are fulfilled, reduce the number of contract disputes and provide a fair and equitable environment within which the parties may operate.
The APP contains three main sections as follows:
GUIDELINES: Contains separate advice to Employers, Contractors and Engineers on what actions need to be taken and the time in which they must act. Typical correspondence and standard forms (over 100) are provided individually for Employers, Contractors and Engineers. Checklists and a search facility provide quick links to appropriate sections of the guidelines.
PROJECTS: Individual project information is provided here with appropriate links to the guidelines. Key information is added for each project with respect to time and financial issues, events affecting progress, claims (different for Employer and Contractor), payments status, and Variations. Drop down lists ensure that correct contract procedures are followed.
An alarm warning list (Follow up) alerts the user to key events such as latest date for receiving the Contract Agreement, Completion Date, earliest time to access the Site, latest date for submission of notices and detailed particulars, expiry of Performance Security etc.
A quick link to important documents such as Appendix to Tender and Particular Conditions is also provided.
NOTES: A useful note taking facility is included for recording events on the Site as they occur. Data entry includes text descriptions, time, location (GPS coordinates), and combined (if required) photographic and sketch images.
